If you have co-owned a property or cohabited with someone and a dispute has arisen between you, you may be able to make a TOLATA claim.

What is a TOLATA claim?

These are claims that determine beneficial ownership of a property, whether owned in joint names or in the sole name of just one person. They are made under the Trusts of Land and Appointment of Trustees Act 1996 (TOLATA).

The provisions of the Act allow the court to make decisions concerning beneficial ownership of a property, whether a property should or should not be sold and who should occupy the property.

Our team are able to look at all options for resolving such issues, including through negotiation or mediation.

If, however, it is necessary to bring a case before the courts we are experienced in litigating these issues and have sound knowledge to ensure your case is presented in the most favourable fashion.
