Judgement
Enforcement
Having spent time and money on obtaining an order from the court, nothing is more frustrating than finding the courts order is either being ignored or unenforceable.
If you have instructed us to obtain the order from the court, we will already have provided you with advice on whether the order is likely to be enforceable. Once the order has been obtained, there are a number of ways and mechanisms which can be used to enforce the order. In cases where the court has made a monetary award we can consider –
- County court bailiffs / High Court Enforcement Officers
- Debt collectors
- Orders for debtor questioning
- Charging orders
- Attachment of earnings order
- Third party debt orders
- Bankruptcy
Often careful evaluation of the evidence of the debtor’s circumstances are required to save money on pursuing a form of enforcement that is unlikely to work. We therefore recommend speaking to one of our specialists who can provide you with advice on the most likely way to recover the money that is due to you.
